1. Acceptance of Terms

By accessing and using PromptCache ("the Service"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. User Accounts

You are responsible for maintaining the security of your account and password. PromptCache cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account.

3. User Content and License

You retain full ownership of the prompts, images, and other content you submit to the Service. However, by submitting content, you grant PromptCache a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute such content in connection with providing and promoting the Service.

You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights.

4. Prohibited Conduct

You agree not to use the Service to:

• Upload or distribute content that is illegal, harmful, threatening, abusive, harassment, defamatory, or hateful.
• Upload content depicting non-consensual sexual acts or child sexual abuse material (CSAM). We have a zero-tolerance policy for CSAM and will report it to authorities.
• Impersonate any person or entity or falsely state your affiliation.
• Interfere with or disrupt the Service or servers/networks connected to the Service.
• Scrape or automatically harvest data from the Service without express permission.

5. NSFW Content Policy

PromptCache allows adult (NSFW) content provided it is:

• Consensual and involves fictional characters or consenting adults.
• Properly tagged and marked as sensitive/NSFW.
• Not displayed in public "Safe Mode" feeds.

Failure to properly tag NSFW content may result in account suspension.

6. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason continuously, including without limitation if you breach the Terms.

7. Limitation of Liability

In no event shall PromptCache, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.
