DMCA & Copyright Policy

PromptCache respects the intellectual property rights of others and requires its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement relating to material on the PromptCache service that are reported to our Designated Copyright Agent identified below.

Hosting & Content

PromptCache hosts material submitted by its users, and also hosts an archive of prompt material that was previously collected from publicly accessible sources. Collection of new third-party material has been discontinued. We host and serve copies of some media files for platform performance and reliability, and we accept full responsibility for processing valid DMCA takedown notices for any material hosted on our infrastructure, regardless of how it came to be there. Archived third-party material is excluded from search-engine indexing.

Designated Copyright Agent

Submit a Takedown Notice

If you are the owner of a copyright, or are authorized to act on the owner's behalf, and you believe that material on PromptCache infringes that copyright, send a written notice to our Designated Copyright Agent at the address above. Your notice must include all of the following:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing (URLs are required).
• Your contact information (Address, telephone number, and email).
• A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We will act on complete notices expeditiously. Notices that omit any of the required elements may not be effective and may be returned to you for completion.

Counter-Notice

If you believe material of yours was removed or disabled as a result of mistake or misidentification, you may send a counter-notice to our Designated Copyright Agent at the address above. Your counter-notice must include all of the following:

• Your physical or electronic signature.
• Identification of the material that was removed or disabled, and the location at which it appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, and telephone number.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which PromptCache may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

Upon receipt of a complete counter-notice we will forward it to the original complainant. Unless the complainant notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the removed material in not less than 10 and not more than 14 business days after receipt of the counter-notice.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), PromptCache has adopted and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We record each takedown notice we act on against the account that submitted the affected material. An account that is the subject of repeated valid notices, and that does not successfully counter-notice, will be suspended and may be permanently terminated. We may also terminate an account immediately, without regard to the number of prior notices, where the infringement is flagrant or where the account was created for the purpose of infringement.
